Terms of Service

1. Acceptance of These Terms

These Terms of Service ("Terms") constitute a binding agreement between the individual accessing or using the Seek Halal application or website (the "Service") and Sunshower Labs (ABN 35 680 029 477) ("Sunshower Labs," "we," "us," or "our"). By creating an account, accessing, or using the Service in any manner, the user ("you" or "User") agrees to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

You must be at least 13 years of age to create an account or contribute content to the Service. If you are under the age of majority in your jurisdiction, you represent that you have obtained any consent required by the laws applicable to you, and that your use of the Service otherwise complies with all laws applicable in your jurisdiction, including any minimum age requirements that may apply to services of this nature where you reside. It remains your responsibility to ensure your use of the Service complies with local law, regardless of the eligibility age stated above.

3. Description of the Service

Seek Halal is a community-driven platform that allows users to discover, add, and share information regarding the halal status of restaurants and food establishments. The Service relies substantially on information submitted by users, including verifications, photographs, comments, and suggested edits. Restaurant location and identifying details are retrieved through third-party mapping services.

4. Accounts

You may create an account using Google sign-in, Apple sign-in (where available), or an email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You must provide accurate information when creating an account and must promptly update any information that becomes inaccurate. You may not create more than one account, impersonate another person, or create an account on behalf of another individual without authorisation.

5. User Content

"User Content" means any verification, review, comment, rating, photograph, suggested edit, restaurant listing, or other material submitted through the Service.

5.1. By submitting User Content, you grant Sunshower Labs a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable licence to use, reproduce, display, distribute, and create derivative works from that User Content in connection with operating, promoting, and improving the Service, including on any successor platform or website operated by Sunshower Labs.

5.2. You represent and warrant that you own or have the necessary rights to submit any User Content you provide, and that your User Content does not infringe the rights of any third party.

5.3. You are solely responsible for your User Content. Sunshower Labs does not endorse, and expressly disclaims responsibility for, any User Content submitted by users.

6. Community Guidelines

Your use of the Service is additionally governed by the Seek Halal Community Guidelines, available within the application, which are incorporated into these Terms by reference. Violation of the Community Guidelines constitutes a violation of these Terms.

7. Accuracy of Information; No Warranty as to Halal Status

7.1. The Service aggregates halal status information submitted by individual users based on their own evidence and personal understanding. Sunshower Labs does not independently investigate, certify, verify, or guarantee the accuracy, completeness, or currency of any halal status, verification, evidence category, or other information displayed on the Service, whether submitted by users or retrieved from third-party sources.

7.2. Determining whether a particular establishment meets your own personal, religious, or dietary standards remains your sole responsibility. Sunshower Labs strongly encourages users to independently confirm halal status directly with an establishment before relying on any information presented through the Service, particularly where dietary or religious observance is a material concern.

7.3. Sunshower Labs makes no representation regarding the ownership, religious affiliation, business practices, food safety standards, or certification status of any restaurant or establishment listed on the Service. Restaurant listings do not constitute an endorsement, partnership, or affiliation between Sunshower Labs and the listed establishment.

8. Third-Party Services

The Service integrates certain third-party services, including mapping and location data, authentication, and email delivery. Your use of features relying on these services may be subject to the applicable third party's own terms and privacy practices, over which Sunshower Labs has no control.

9. Moderation and Enforcement

Sunshower Labs reserves the right, but has no obligation, to review, moderate, remove, or restrict access to any User Content or account at its sole discretion, including where User Content is reported by other users or believed to violate these Terms or the Community Guidelines. Moderation decisions are made on a good-faith basis and Sunshower Labs is not liable for any decision to remove, retain, or decline to act upon any User Content.

10. Intellectual Property

The Service, including its software, design, branding, trademarks, logos, and the compilation and organisation of the underlying database, is the property of Sunshower Labs or its licensors and is protected by applicable intellectual property laws. Except for the licence granted with respect to your own User Content, nothing in these Terms grants you any right, title, or interest in the Service.

11. Suspension and Termination

Sunshower Labs may suspend or terminate your account or access to the Service, with or without notice, for any violation of these Terms or the Community Guidelines, or for any other reason at its discretion, including discontinuation of the Service in whole or in part. You may stop using the Service or request deletion of your account at any time through the Service's account settings. Provisions of these Terms that by their nature should survive termination, including Sections 5, 7, 10, 13, and 14, will survive.

12. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. SUNSHOWER LABS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUNSHOWER LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING ANY RELIANCE ON HALAL STATUS INFORMATION OR OTHER USER CONTENT, EVEN IF SUNSHOWER LABS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING CONSUMER GUARANTEES THAT MAY APPLY UNDER THE LAWS OF YOUR JURISDICTION.

14. Indemnification

You agree to indemnify and hold harmless Sunshower Labs from any claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising from your use of the Service, your User Content, or your violation of these Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of South Australia, Australia, without regard to conflict of law principles, regardless of the country from which you access or use the Service. You agree to submit to the exclusive jurisdiction of the courts of South Australia, Australia, for the resolution of any dispute arising from these Terms or your use of the Service, except where applicable local law grants you a non-waivable right to bring proceedings in your own jurisdiction.

16. Changes to These Terms

Sunshower Labs may modify these Terms at any time. Material changes will be reflected by an updated version of this document. Continued use of the Service following any change constitutes acceptance of the revised Terms. You should review these Terms periodically.

17. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Sunshower Labs' failure to enforce any provision of these Terms shall not constitute a waiver of that provision. You may not assign these Terms without Sunshower Labs' prior written consent. These Terms, together with the Community Guidelines and the Privacy Policy, constitute the entire agreement between you and Sunshower Labs regarding the Service.
